EB-1a Visa for Aliens of Extraordinary Ability

Requirements for Aliens with Extraordinary Ability
EB-1A visas (aliens of extraordinary ability) provide an opportunity for U.S. immigration for foreign nationals who have risen to the top of their field. This visa category allows people with extraordinary ability in business, sciences, athletics or the arts to obtain permanent residency in the United States. There is also a temporary version of this visa called the O-1 visa.

Attorney, Scott M. Beller. Over the past 25 years, has helped many hundreds of businesses, professionals and skilled workers reach their immigration goals. From my law office in Chicago, I represent employees and employers throughout Illinois and the nation.
Advantages of EB-1A Visas

If you meet the qualifications as an alien of extraordinary ability, there are a number of advantages to obtaining an EB-1A visa, including:

    * You can work and live in the United States permanently.
* Your employer does not need to go through the PERM labor certification process.
* A permanent job offer is not required.
* Your petition does not need to be signed by an employer.
* You can apply for family-based immigration for your spouse and children under age 21, who can accompany you on the same petition.

However, many people who believe they should qualify as aliens of extraordinary ability have their petitions turned down. As your lawyer, I will review your background and credentials and let you know if you meet the qualifications, or whether it makes more sense to pursue another visa category.
What is Extraordinary Ability?

Extraordinary ability means that you have reached a level of expertise indicating that you are one of a small percentage of people who have risen to the very top of your field of endeavor.

To qualify, you must submit documentation such as outstanding achievements, published papers, original contributions of major significance in your field, or other types of recognition.

Chicago, IL Immigration Lawyer

Handling Asylum Cases

Scott M. Beller & Associates

The U.S. Citizenship and Immigration Services (USCIS) recognizes fear of persecution as a ground for immigration to the United States. If you can prove that you have suffered past persecution or have a well-founded fear of persecution in the future based on your race, religion, national origin, political opinion, or membership in a particular social group you may qualify for asylum.

Over the past 25 years Immigration attorney Scott M. Beller has helped victims of persecution receive asylum in the United States. He has represented clients who have faced torture and beatings. As he has listened to his clients' accounts of beatings, imprisonment, and torture, he has often found myself in awe of their bravery in standing up to repressive governments in their home countries.

What is Asylum?

Asylum is a form of protection for people in the United States who cannot return to their native country because they have been persecuted or fear they will be persecuted.

Examples of qualifying grounds for asylum are:

Persecution based on race

Religion

Nationality

Political opinion

Membership in a social group.

Asylum is available to individuals who are already living in the United States or who are seeking to gain entry to the United States as a port of entry.

There is no quota on the number of people who may be granted asylum each year.

Attorney Scott Beller will guide you through the asylum process and help you present the documentation for your case.
